WHEREAS:

As of March 10, 2020, Governor Baker has declared a State of Emergency in Massachusetts due to Coronavirus/COVID 19; and

 

 

WHEREAS:

While we are doing everything in our power to prevent the spread of disease in our communities, and mitigate the impact of this public health on our residents, businesses, and essential services during this time, the pressure on individual residents and families is immense; and

 

 

WHEREAS:

COVID-19-related disruptions and potential income loss may result in difficulty for residents affected by the pandemic to pay rent, or pay rent timely, support of this moratorium will establish needed protections for the City’s most vulnerable residents; and

 

 

WHEREAS:

Boston Rep. Kevin Honan, House Chairman of the Joint Committee on Housing, and State Rep. Mike Connolly, of Cambridge, filed HD.4935, An Act Providing for a Moratorium on Evictions and Foreclosures During the COVID-19 Emergency to pause evictions and foreclosures across the state until Governor Baker’s state of emergency concludes; and

 

 

WHEREAS:

Through this legislation, courts overseeing eviction processes would be banned from entering a judgment; issuing an execution for possession of a unit; accepting filing of a complaint, summons, or writ; and denying a stay of execution or a continuance of a case as requested by a defendant, among other measures; and

 

 

WHEREAS:

Creditors and mortgagees would be barred from carrying out foreclosures, publishing notice of a foreclosure sale to evicting tenants; now therefore be it

 

 

RESOLVED:

That the City Council go on record in support of this temporary moratorium on evictions, foreclosures, and their proceedings in order to protect tenants facing significant financial burdens due to the global COVID-19 pandemic; and be it further

 

 

RESOLVED:

That the City Clerk be and hereby is requested to forward suitably engrossed copies of this resolution to the Cambridge Legislative Delegation.
